Whereas
The Convention for the Protection of Human Rights and Fundamental Freedoms (1950) states that “the enjoyment of the rights and freedoms set forth in this Convention shall be secured without discrimination on any ground such as sex, race, colour, language, religion, political or other opinion, national or social origin, association with a national minority, property, birth or other status” (art. 14) and that “1. Everyone has the right to respect for his private and family life... 2. There shall be no interference by a public authority with the exercise of this right except such as is in accordance with the law and is necessary in a democratic society in the interests of national security, public safety or the economic well-being of the country, for the prevention of disorder or crime, for the protection of health or morals, or for the protection of the rights and freedoms of others” (art. 8)

Whereas
The United Nations International Conference on Population and Development (ICPD) held in Cairo in 1994 issued, among others, the objective to ensure within 2015 “that comprehensive and factual information and a full range of reproductive health care services, including family planning, (were) accessible, affordable, acceptable and convenient to all users”.

The signatories of the Oviedo Convention for the protection of Human Rights and dignity of the human being with regard to the application of biology and medicine provides that “parties to the Convention shall protect the dignity and identity of all human beings and guarantee everyone, without discrimination, respect for their integrity and other rights and fundamental freedoms with regard to the application of biology and medicine”

a broad network of scientists, NGO's representatives, politicians and leading personalities (as among others Elly Katabira, President of the International AIDS Society; Evan Wood, PhD, founder of the International Centre for Science in Drug Policy; Julio Montaner, President of the International AIDS Society; Fernando Henrique Cardoso, President of Brazil 1995-2003, and Adeeba Kamarulzaman, Head of the Department for Infectious Diseases, University of Malaysia) have been united under the so-called "Vienna declaration" about drug policies, health and human rights
